Terms and Conditions of Use

1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of the mobile application The Throne of Draxos ("the App", "the Game", "the Service"), developed and operated by Krethz Games under the brand Krethz Games ("we", "us", "our").

By downloading, installing, accessing, or using the App, you agree to be legally bound by these Terms. If you do not agree, do not use the App.

These Terms should be read together with our Privacy Policy, which explains how we process your personal data.

2. Service Description

The Throne of Draxos is an online multiplayer social deduction game for 5-10 players. Participants are either part of a spaceship crew or hidden alien infiltrators. The objective varies by team:

• Galactic Crew: complete missions and discover the aliens
• Alien Infiltrators: sabotage missions without being discovered

Main features:

• Room code-based games (no public random matchmaking)
• Roles with unique abilities
• Optional purchases (cosmetics, ad removal, expansions)
• Virtual currency (Draxos Credits) obtainable by playing or watching ads
• Achievement system

The Service is provided "as is". We reserve the right to modify, suspend, or discontinue any aspect of the Game at any time without prior notice.

3. User Accounts

3.1. Account types

You can use the App in two ways:

• Guest user (anonymous): temporary access without saving progress. When logging out, you lose unlocked cosmetics, achievements, and virtual credits.
• Registered user (Google/Apple): persistent account that saves your progress. Requires a valid email provided by your OAuth provider.

3.2. Age requirements

You must be at least 16 years old to create an account.

Users between 13 and 16 may use the App with parental supervision. Users under 13 cannot use the Service under any circumstances.

By registering, you declare that you meet the age requirement. We may request verification at any time and suspend accounts of users who do not meet this requirement.

3.3. Account responsibility

• You are responsible for maintaining the security of your Google/Apple account used for login
• You cannot share your account with others
• You must notify us immediately if you suspect unauthorized access
• We are not responsible for losses resulting from unauthorized use of your account

4. User-Generated Content (UGC)

4.1. What content you can generate

Users can create the following content within the App:

• Profile name (display name): maximum 20 characters, visible in game rooms
• Emoji reactions: emojis and quick phrases sent during games

Important: Although this content is only visible to players in your room (not public on the internet), it is stored on our Firebase servers and is subject to conduct rules.

Your username and generated content CANNOT contain, promote, or include:

We recognize that The Throne of Draxos is a social deduction game among adults where informal or colloquial language may arise during gameplay. We allow a certain degree of vulgar language as long as:

• It is not directed as harassment or personal attack
• It does not fall into the prohibited categories above (hate, explicit sexuality, etc.)
• It is proportionate to the context of adult social gaming

Acceptable example: "Damn, they caught me" during a game.
Unacceptable example: Username with sexual or racial slurs.

4.4. Our right to moderate

We reserve the right, but not the obligation, to:

• Review usernames and generated content
• Edit, hide, or remove content that violates these Terms
• Change offensive usernames to a generic name (e.g., "Player_12345")
• Temporarily or permanently suspend accounts for violations
• Report illegal content to competent authorities

We do not actively monitor all generated content, but will act when we detect violations or receive reports.

4.5. License to your content

By creating content in the App, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, and display that content exclusively for the purpose of operating and improving the Service.

You retain all rights to your content. You may request deletion of your account and data at any time according to our Privacy Policy.

5. User Conduct

In addition to content rules, the following is prohibited:

• Cheating: using exploits, bugs, client modifications, bots, or any technique to gain unfair advantage
• Service abuse: creating multiple accounts to evade suspensions, conducting DDoS attacks, overloading servers
• Reverse engineering: decompiling, reverse-engineering, or extracting code from the App (permitted only for responsible security research with prior report)
• Account selling or transfer: accounts are personal and non-transferable
• Interference with other players: repeatedly abandoning games disruptively, systematic trolling

6. In-App Purchases and Virtual Currency

6.1. Available products

You can purchase the following digital products within the App:

• Ad removal: permanent one-time purchase
• Draxos Credits packages: virtual currency to unlock cosmetics
• Game expansions: new roles and mechanics (e.g., "Alien Invasion")
• Premium cosmetics: avatars, decorative frames

6.2. Draxos Credits (virtual currency)

• Draxos Credits can be obtained by purchasing them or free by playing/watching rewarded ads
• They have no real monetary value outside the App
• They are non-refundable (unless required by applicable law)
• They are non-transferable to other accounts or people
• If your account is suspended or you delete your account, you lose all accumulated virtual credits

6.3. Payment processing

All purchases are processed through:

• Android: Google Play Billing (subject to Google Play Terms)
• iOS: Apple App Store (subject to iTunes Terms)

We do not have access to your payment data (cards, bank accounts). For refunds, you must contact Google or Apple according to their refund policy.

6.4. Refund policy

All purchases are final. We do not offer direct refunds except when required by applicable law or in case of:

• Demonstrable technical error preventing use of purchased content
• Duplicate charges due to system error

To request a refund for these reasons, contact hello@krethzgames.com within 14 days of purchase with proof of charge.

7. Advertising

The free version of the App includes ads provided by Google AdMob:

• Banner ads: on certain screens (lobby, settings, Draxos Bazaar)
• Interstitial ads: occasional between game sessions
• Rewarded ads: optional to obtain Draxos Credits

You can remove banner and interstitial ads by purchasing the "Remove Ads" option (rewarded ads remain optionally available).

Ads are subject to AdMob Policies. We do not control the content of displayed ads.

8. Intellectual Property

8.1. Our rights

All rights, titles, and interests in and to the Service, including but not limited to:

• The "The Throne of Draxos" brand and logo
• The App's source code
• Graphic assets (characters, icons, backgrounds, animations)
• Game mechanics and rules
• Music and sound effects
• Texts and narrative

...are the exclusive property of Krethz Games / Krethz Games or its licensors, and are protected by international intellectual property laws.

8.2. Limited license

We grant you a personal, non-exclusive, non-transferable, revocable, and limited license to install and use the App on your personal devices exclusively for your non-commercial recreational use.

You may not:

• Copy, modify, distribute, or sell the App or its components
• Create derivative works based on the App
• Use game assets in other projects without written permission
• Use the "Draxos" brand commercially

8.3. Inspiration from existing games

The Throne of Draxos is an original game inspired by social deduction mechanics of the genre (like "Avalon" or "The Resistance" type games). All specific implementations, art, role names, and narrative are original creations of Krethz Games.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE".

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the Service will be uninterrupted, error-free, or secure
• Warranties that the results of use will be accurate or reliable

We do not warrant:

• That the Service will always be available (there may be maintenance, server outages)
• That your progress (achievements, credits) will be preserved in case of serious technical failures
• That purchases made will remain available if we discontinue the Service

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages arising from: (a) your use or inability to use the Service; (b) unauthorized access to your data; (c) interruption or cessation of the Service; (d) bugs, viruses, or malware transmitted by third parties; (e) errors or omissions in content

Our total liability to you in any case shall not exceed:

• The amount you have paid directly to us in the last 12 months, OR
• 50 euros (€50), whichever is greater

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. If you reside in one of them, the above limitations may not apply to you.

11. Suspension and Termination

11.1. By you

You can stop using the App at any time by uninstalling it. Registered users can request complete deletion of their account according to our Privacy Policy.

11.2. By us

We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including:

• Violation of these Terms or the Privacy Policy
• Reasonable suspicion of fraud or illegal activity
• Order from competent authority
• Discontinuation of the Service

Consequences of suspension/termination:

• You lose immediate access to your account
• You lose all Draxos Credits, unlocked cosmetics, and progress (no refund)
• Purchases made (ad removal, expansions) are non-refundable, unless required by law
• We may delete your account and associated content according to our retention policy

12. Changes to the Service and Terms

12.1. Changes to the Service

We may modify, suspend, or discontinue any aspect of the Service (including removal of roles, changes to mechanics, price adjustments) at any time without liability to you.

If we completely discontinue the Service, we will make a reasonable effort to notify you at least 30 days in advance.

12.2. Changes to these Terms

We may update these Terms occasionally. Significant changes will be notified by:

• Updating the "Last updated" date at the top
• Notice in the App when logging in (for material changes)

Your continued use of the Service after publication of changes constitutes your acceptance of the new Terms. If you do not agree, stop using the App.

13. Applicable Law and Jurisdiction

These Terms are governed by the laws of Spain, without giving effect to its conflict of law provisions.

For any dispute arising from or related to these Terms or the Service, the parties submit to the exclusive jurisdiction of the Courts and Tribunals of Spain, unless applicable law establishes other mandatory jurisdiction (e.g., consumers may litigate in their place of residence).

Alternative dispute resolution (ADR): In accordance with European consumer protection legislation, you can access the EU online dispute resolution platform at https://ec.europa.eu/consumers/odr.

14. General Provisions

14.1. Entire agreement

These Terms and our Privacy Policy constitute the entire agreement between you and us regarding use of the Service, replacing any prior agreement.

14.2. Severability

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14.3. Waiver

Our failure to exercise any right under these Terms does not constitute a waiver of that right.

14.4. Assignment

You may not transfer or assign these Terms without our consent. We may assign these Terms at any time (e.g., in case of business sale).
